Protecting The Rights Of Injured People In Hyde Park Since 1986

Are owners of pools liable for all accidents that happen there?

With summer just around the corner, now is a great time to talk about premises liability and swimming pools. When you take your kids to the local pool, or you head to a gym for a swim, you want to know that the owner has taken safety seriously. It's essential that you are not hurt as a result of broken stairs, damaged flooring or other issues that the owner should have known about and repaired.

The owner of any property owes a duty of reasonable care to those who enter the property. As an invitee to the property, you're owed the highest level of care. That means that the owner should keep the pool and surrounding area in good condition to prevent your injuries.

What should you do if you slip and fall at a pool?

Not all slip-and-fall accidents are going to lead to premises liability cases. However, if you slipped or fell as a result of damage, slick floors or other issues that should not be present, then the owner may be liable for your injuries.

Will a pool's owner be liable for drowning accidents?

Sometimes, but not always. While tragic, there is a reasonable chance that someone will drown when swimming. If the owner of the pool has the pool in good condition and has taken steps to prevent injuries, then the likelihood of being liable is low. However, if it was their negligence that led to the accident and drowning, then there may be a chance of recovering compensation.
