What should you know before filing a malpractice claim?

Illinois has seen its fair share of medical malpractice cases, and if you've been a victim of malpractice, you may be hoping that you can also file a claim and win compensation for your losses. There are some things you should know, however, if you plan to file a lawsuit.

To start with, there is a statute of limitations on medical malpractice cases. In Illinois, you generally have two years to file a claim after you were injured or discovered the injury. That's something you should ask your attorney about first, especially if you are close to that time limit.

Winning a case isn't as easy as showing that you were injured by a medical professional, either. To win your case, you'll need to show that you were a victim of negligence and that you were injured as a result of that negligence. You have to show that the same injuries likely would not have happened with a different provider taking care of your treatment because your provider violated the appropriate standard of care for your condition.

A different medical provider will need to agree to sign an affidavit that they also believe that malpractice occurred. Some medical providers won't want to do this to their colleagues, so you'll want to speak with your attorney about options for reaching out to medical providers who would be willing to sign that document for you.

Medical malpractice can stem from errors like botching a surgery to failing to diagnose your serious illness. If you are hurt as a result of a physician's mistake, you have the right to explore your legal options -- and you most certainly should!
