Even minor errors can spur a medical malpractice lawsuit

Medical malpractice is a serious concern for patients and their families. If it's been suggested that malpractice may be a cause of your injuries or a loved one's death, then it is in your best interests to talk about your options with your attorney.

Medical malpractice can result from something seemingly small. For instance, you may hear the nurse call you the wrong name and go back to the station knowing that they mean you. However, you know that incorrect name could still be linked to you; if you go on to get a treatment or to see a doctor for a problem, you could find that you're treated for someone else's health problems.

Medical malpractice doesn't have to be intentional, and it often isn't. Malpractice tends to stem from negligence and accidents, not from intentional misconduct. That doesn't mean that a provider can't do something intentionally wrong (because some do), but it's less likely than the provider simply making a mistake.

What should you do if you're a victim of malpractice?

If you are injured and believe malpractice is a cause, it's a smart choice to see another provider to see if you can get a second opinion. If they also agree that something went wrong with your care, then it's possible that you could file a claim and pursue a medical malpractice case. It's fine to speak with your provider, but if they won't admit to a mistake, your attorney may need to reach out to them or to their employer to talk about reaching a settlement for your injuries.
