Can you sue if you're hurt at a park?

It's the spring, and that means that it's a time when more people go outside to see one another. With children heading to parks to play, now is a good time to talk about parks and liability for injuries.

There's no question that children get hurt often. Many times, those injuries are caused by carelessness or falls that have nothing to do with the quality of playground equipment or the state of the park. However, some injuries are a direct result of a park that is in disrepair.

For example, imagine walking across a wooden bridge with your child. The park has it open, and there are no warning signs. Now, imagine that your child ends up falling into the creek below due to the railing snapping. They fall over the edge and several feet to the small streambed below.

In that case, the fact that the wood may have been rotted or deteriorating, the likelihood is that you could hold the park responsible for your child's injuries. Maintenance teams do go to parks regularly and should check the safety of railings, staircases, bridges and other parts of the park. Failing to do so puts people in danger of getting hurt.

What should you do if you're hurt at a park?

Immediately after the incident, you should seek medical help. Your safety is the most important factor in the case. Try to get witness information and photographs of the scene if possible, so that you can show your attorney the state of the park and determine if you can hold the owner of the park liable.
